Facebook Pics Get Kids Arrested

Cops in South Burlington, Vt. bust teens for posting photos of boozing on Facebook.

Did you know that police can actually arrest a kid for photos they place on social networking sites like Facebook and MySpace? We didn't, until we read about the Vermont hockey and lacrosse players charged with possession of alcohol after pictures of the students drinking alcohol appeared on the social networking Web site. WPTZ reports that one of the students was ordered to pay a $330 fine and will have the offense on her permanent record. The other students have opted for a court diversion program that will clear their record if completed successfully.

Attorney and friend of Mom•Logic BJ Bernstein, president and founder of MyFifth.org, weighs in on the matter and gives advice for Moms re: making sure this doesn't happen to your child.

BJ says: "Even when you mark something as private, it's easy for someone technically savvy to get into it." She adds that she currently has a case where she's hired a computer expert to go into witnesses' Facebook entries to search for clues. "It really is a World Wide Web. Law enforcement and school officials are looking at Facebook regularly," she warns.

What about the First Amendment? Speaking to teens, Bernstein says that your constitutional rights are a little different when you're in high school versus when you're an adult. "At school, your locker and car can be searched without a search warrant if they have reasonable suspicion a crime has been committed," she explains. "In Colorado, there's a case right now where school officials searched kids' cell phones looking for clues. Don't make the mistake of thinking your First Amendment rights will always protect you, because at this stage you have less rights than you would if you were over 18."

A clear moral to this story: Warn your kids to be especially cautious about what they post on Facebook. Because too often, those photos can and will come back to haunt them.

Your children have the same rights as any citizen. You should give them locked containers for inside their lockers and tell them to secure their cell phones with pass-numbers. Which they cannot be coerced into giving. Stand up or be walked upon.
