When Teen Crimes Go Unpunished

After a fellow student assaulted her, a teen victim was told to avoid him or transfer.

Kelsey Balzafiore, 13, was sexually assaulted by a fellow classmate, but things got even worse for the Staten Island honor student when her attacker was not only kept in school, but also enrolled in her summer school class.
Tomorrow, Balzafiore's lawyer will request a date for a lawsuit against the city, its Department of Education, and the NYPD's school safety division for negligence.
"I feel like I did something wrong," Balzafiore exclusively told the New York Post. "I feel like I was being punished. I don't want this to happen to other girls. This whole experience since the attack has been an absolute nightmare."
Robert Swen (now 19), reportedly grabbed Balzafiore (now 16), dragged her down a stairwell to a basement, ripped open her pants and groped her private parts. He denies the charges.
The girl's mother, Loretta Rice, complained to the school and had cops arrest Swen after her daughter identified him in front of other students. Swen was suspended for several days and removed from Balzafiore's class--but not the school. Police said Balzafiore could leave through the back door of the school to avoid him, or transfer. After staying home for six weeks before transferring to another high school, Swen appeared in her summer school class.
The case against Swen was ultimately dismissed because the Staten Island District Attorney's office didn't respond as "ready for trial," even though Balzafiore's lawyer called the DA's office 15 times, requesting them to do so.
What would you do if this was your daughter?
The attacker (loser) obviously flunked or was held back a grade or two. He should be kicked out of the school.
In NY state non-major subjects such as your home economics, phys. ed, computer classes are open to all grades once the kids are out of elementary school (grades 6/7-12).

I have a daughter in high school and it is becuse of teens like him I’m scared to let her go to school events and after school activities.
Did anyone actually SEE the alleged assault? Or is it just her word against his? It is possbile she could just be some vindictive girl who was mad at him for something else and made this story up. It DOES happen. I love how everyone jumps on the girls side and automatically believes her without any proof whatsoever that this actually occured. The boy was evidently not prosecuted…and the D.A. does not take these cases lightly. They didn’t not try the boy just because they didn’t feel like it. The MUST have been no proof that this even occured, or else he would have been arrested, charged, and convicted for sure.

“Swen then grabbed her and dragged her down a stairwell to the basement, where he forcibly kissed her, opened her pants and groped her private parts,” said Bryan Swerling, another of Kelsey’s lawyers.”
The girl’s mom, Loretta Rice, said that when she complained at school the next day cops who were called arrested Swen on sex-abuse charges after having Kelsey point him out in front of other students.
1)So she asked if anyone had a dollar and Swen responded and they walked off together. Someone had to see this happen! Where are they? Becasue no one is saying the saw the two walk off together.

It’s a high school with a ton of perople in it…if someone suddenly grabs you and drags you down a hallway I guarantee your immediate reaction is going to be to scream. Someone would have heard her and came looking to find out what was going on.

Did she not tell her mom until the next day…or did her mom just sit around all night and wait to talk to school officials or the police? Because if that was my daughter…I would have been to the school and the police immediately. And if the school was closed, I would have went to the prinipals home address. No way I’m sitting around doing nothing when my daughter tells me she was assaulted. And if she waited until the next…that’s reason to question her story even more.
By the way, this innocent honor roll student was just arrested on assault charges of her own.
