The 47-year-old was approached by the California Highway Patrol in Santa Barbara after a witness saw the actress "driving erratically" while leaving a parking lot in Montecito. The witness, concerned for Locklear's safety, called the CHP, who found her on a nearby highway where she was partially blocking the roadway. Locklear was taken into custody, where she was tested for alcohol and drugs and booked on suspicion of driving under the influence of prescription drugs. She was released without having to post bail. In June, Locklear checked into a medical clinic to seek help for anxiety and depression.

In April 2008 she divorced from her husband of 11 years, Richie Sambora, who was arrested for a DUI earlier this year. They have a 10-year-old daughter named Ava.

Judge Jeanine Pirro says because Richie and Heather have now both gotten DUIs, their parenting skills can be called into question. "The red flags have been raised," she says. "Any judge worth his or her salt will look at this and review custody and visitation." She says it's likely that a condition of visitation will now be that they can't drive with Ava in the car.

Since Heather was allegedly under the influence of prescription medication rather than drugs or alcohol, will that play in her favor? Not necessarily, says Judge Pirro. "First, she has to prove that she was indeed under the influence of prescription drugs. After that, the question will be: What was the warning on the drug? If she was never warned not to drive on these meds, she's home free. But maybe it said don't drive, and she did it anyway. That's still a big problem. A judge will likely look at whether or not this substance is affecting her ability to parent."

They make it sound like she was on a bender. She had an adverse reaction to the prescription medication she was on, it could happen to anyone.

You’d think Jesus would be a little too busy to be dealing with Heather Locklear’s divorce and pressures. Doesn’t that dude have anything else to do?
