Family of Dead Wal-Mart Worker Files Suit
The siblings of a New York Wal-Mart worker trampled to death by crazed bargain shoppers have filed suit against the discount retailer and the shopping center where the store is located.

Jdimytai Damour's three sisters and brother filed the wrongful death suit Wednesday. Their attorney Jordan Hecht said "We're going to be suing Wal-Mart as well as the owner of the mall, the security company, and we're contemplating an action against the police and the county of Nassau, although we're waiting to see what our investigation fleshes out about their involvement."
The suit claims Damour's death resulted from "the carelessness, recklessness, wanton disregard for public safety and gross negligence of the defendants ... in the staging, conducting and advertising for sales events." Hecht said the store should have been prepared for the crowds because it offered serious sale prices on a variety of items.
The 6'5", 270 lb. Damour, was a temporary worker at the store. He was asphyxiated while trying to protect a pregnant shopper from bargain hunting mob pounding the doors down to get into the store. Funeral arrangements are in the works, but will be kept under wraps to protect the family's privacy.
