Attorneys for Roman Polanski, director and fugitive, are requesting a dismissal in the case of Polanski's unlawful intercourse with a 13-year-old girl over 30 years ago.
In 1978, Polanski plead guilty to charges but fled to Europe before he was sentenced.
Polanski's representatives have tried to get his case dismissed in the past, however, he would be required to submit himself to the court's jurisdiction and appear in court in order for the Superior Court to make a ruling.
The victim in the case, Samantha Geimer, is now in her mid 40's and has publicly come forward to say that Polanski has been treated unfairly by the judicial system. "This should have been settled a long time ago," she said in a 2003 interview.
The first requested court date has been set for the Superior Court to take place next month. It is unknown whether or not Polanski would be willing to show up in person.
