'I'll Never Give Up' Brazil Custody Fight, Vows Dad

Today Show: Though a New Jersey dad's hopes of finally regaining custody of his son from a Brazilian family were dealt another crushing setback, he vowed that he will never give up his battle to bring the boy home.

"I'll never give up on my son," David Goldman declared to TODAY's Meredith Vieira Wednesday morning via satellite from Rio de Janeiro. "It's not over."

Goldman had flown to Brazil on Monday after a Brazilian federal court judge ruled that after nearly five years, 9-year-old Sean Goldman had to be returned to his father at the U.S. consulate Wednesday afternoon. On Tuesday, one justice on the Supreme Court of Brazil, acting on a petition filed by a minor political party, canceled the order and ruled that more time was needed to determine if Goldman should get his son back.

Wednesday morning, Goldman looked exhausted and emotionally drained as he voiced his determination to continue his nearly five-year battle.

Goldman said he hoped to at least see Sean on Wednesday, but he knew that the latest twist in this international custody case that has gone to the highest levels of the American and Brazilian governments would prevent him from finally bringing Sean back to Tinton Falls, N.J.

"Bottom line right now: My son is not going to be on a plane coming home with me this afternoon," Goldman told Vieira.

The distraught father said he fears for his son's well-being the longer the legal tug-of-war continues.

"This isn't good. This isn't good at all," he told Vieira. "He's got to come home with me. He's in a very unhealthy environment, and this has to stop."

I’m not sure why the Brazilian government is intervening with something they clearly should not be intervening. This is a family matter. The boy is American and has his father. That Brazilian step father is one greedy and selfish son-of-a blank. He lost his baby and his wife and now wants to keep something that CLEARLY isn’t his.

When Elan was returned to his father, yes, it upset many, but no country, free or otherwise can intervene in a parent’s quest to get his child.

I am shocked and disgusted by this. “Acting on a petition filed by a minor political party, canceled the order and ruled that more time was needed to determine if Goldman should get his son back.” A petition filed by a minor political party? Seriously? Are they trying to turn this into a game? “You can have it, on second thought, no you can’t”. The President should cut off ties with Brazil if they keep up this insanity. He is the boy’s biological father, he has legal rights to him, the biological mother, who is deceased took him to live in Brazil without the father’s knowledge or consent. And as far as I know, the child has not expressed any desire to remain with his stepfather, so what the hell?!?! Seems to me that Brazilians have a knack for taking other people’s children and then claiming them as their own. Look at Gisele Bundchen, who proudly professed that she didn’t care if Bridget Moynahan’s was the biological mother of her stepchild, she considered herself the mother. If she moves to Brazil with Tom Brady, Bridget might as well kiss her parental rights goodbye…

I can’t belive this man in Brasil realy is doing this just because he wants this boy, I think he wan’ts some kind of money,,,,,,, see how fast he’ll give the boy back.
