Teacher Suing For Fall Caused by Condoms

UPI.COM: A New York teacher alleges in a lawsuit she slipped on garbage, including condoms, and hurt herself due to negligence on the part of school officials.
High School of Art & Design teacher Karen Hollander is suing the Department of Education, alleging the dispersal of condoms to students at the Manhattan school resulted in the accident that left her with injuries to head and nervous system, the New York Daily News said Saturday.
Hollander alleges school officials should have taken action to prevent garbage, including the distributed condoms, from collecting on the floor of the school's cafeteria prior to her accident on Nov. 12, 2008.
"They caused, allowed and permitted condoms to be distributed by school personnel to the students, many of which were opened during the school lunch period and thrown on the floor," Hollander alleges in the suit.

Are you KIDDING ME? Suing the school for slipping on garbage and condoms? Where is her common sense? Give me a break! Geesh!

Certainly the school has a responsibility to enforce codes of cleanliness, but the report generates a picture of a trash heap rather than a specific location. To find garbage of any kind on the cafeteria floor sounds like the local health officials might want to investigate the school. The law suit is a bit on the slippery side of reasonable. How slippery for example is a condom, used or unused? Sounds more like she is just tired of teaching, which in schools today that is understandable, but to sue the school for her failing to be observant enough to see the area of question is in itself questionable

I remember my high school lunches, and when the students are there there is no way janitorial staff could have kept up with every strange bit of trash the kids threw on the ground during lunch hour. They had to clean up after and between, if the condoms had been used(unlikely) or left there for long hours during the day or for many days, i† makes sense, but over the span of a single lunch period the floor wasn’t sterile? Wish I could have lived in that reality.
